Answer: Life Care Planning is a combination of objective review and subjective interpretation based on comprehensive assessment for a planning process designed to address the long-term healthcare and related needs of individuals facing chronic illness, injury, or disability. It helps provide a clear roadmap for future care and associated costs. By incorporating Life Care Planning into your case, you can ensure that your clients receive the necessary care and support they require, while also establishing a solid foundation for legal proceedings.

2. Is a Medicare Set-Aside Analysis reliable for valuing future medical in terms of Medicare-covered expenses at settlement?

Answer: The short answer is no. There are a number of subtle, yet distinct differences between a Medical Cost Projection or a Life Care Plan and a Medicare Set-Aside in terms of the methodology for arriving at a final valuation. While there are a multitude of methodologies at work that differ, the methodology that has the greatest impact on the final valuation is that of the use of a Rated Age report. A Rated Age report is used in every Medicare Set-Aside written and is an acceptable industry standard; however, in a Medical Cost Projection or Life Care Plan, the use of a Rated Age report is far less, as it is typically reserved in cases of extreme catastrophic injury, such as with a spinal cord injury.

The Medical Cost Projection involves estimating the future medical expenses related to an injury or medical condition. They are essential when determining the potential costs of medical care, rehabilitation, and treatment. These projections are valuable for settling cases, calculating damages, and ensuring fair compensation for clients involved in personal injury or workers' compensation claims.

Answer: The Medicare Secondary Payer Act (MSP) is a federal law that designates Medicare as a secondary payer in certain situations, typically when another primary payer exists (e.g., private insurance, workers' compensation). Compliance with MSP is crucial to prevent Medicare overpayments and potential legal consequences. Failing to comply with MSP requirements can result in penalties.
